Glossary of Personal Injury Compensation Terms

Barrister: A barrister will present the claimants case in a court of law.

Civil Courts: A civil court hears civil cases, such as personal injury claims, rather than criminal cases.

Claimant: The person making a claim for compensation.

Compensation or Damages: The money which is awarded to a claimant if they have a successful injury claim.

Conditional Fee Agreement: This is also known as no win no fee. The fee is paid in the result of a victory being won in the case. It is often a percentage of the compensation awarded.

Defendant: The organisation or individual which is responsible for paying compensation to the claimant if the claim against them is successful.

Duty of Care: A legal term which refers to the responsibility individuals or organisations have towards one another.

General Damages: These are compensation payments that are awarded for the direct injuries that result from an accident.

Negligence: The actions or lack of actions which result in the injury.

Special Damages: These damages refer to compensation paid to make up for any financial loss that has resulted from suffering an injury or illness.

Small Claims Court: The small claims court handles relatively small claims for personal injury compensation.
